Police say an Acworth man was struck and killed early Saturday morning in an accident that resulted in another Acworth man being charged with driving under the influence of alcohol, failure to maintain lane and first-degree homicide by vehicle.

According to Cobb Police Offcier Mike Bowman, James Underwood had parked his Ford F-150 truck in an area between the northbound and southbound lanes along Mars Hill Road near Cobb Parkway.

Underwood reportedly had exited his truck to put some advertising signs along the side of the road when at around 12:40 a.m., a southbound Chevrolet Silverado left its lane and collided into Underwood’s truck.

Underwood, 50, who was standing by his track, was also hit and knocked to the ground. He was taken to WellStar Kennestone Hospital where he was pronounced dead due to the injuries he sustained from the collision.

The operator of the Silverado, Kenneth Chitwood, 48, did not sustain serious injuries. He was arrested on the three charges and was taken to the Cobb County Adult Detention Center.
