Downed Pedestrian Hit, Killed by Car

The deceased has been identified as 35-year-old James Lamar Scoggins of Powder Springs.

The pedestrian killed Wednesday on U.S. 41 in the Bartow County area of Acworth, was lying on the shoulder of the road before the crash occurred,  spokesman Gordy Wright said.

Officials identified the man as James Lamar Scoggins, 35, of Powder Springs. While troopers aren't sure why he was lying on the side of the roadway, they say alcohol intoxication is a possibility.

Authorities are testing a sample of the victim's blood, according to Wright.

About 7:35 p.m., a deputy on patrol spotted a 36-year-old Villa Rica woman in the middle of U.S. 41 northbound attempting to flag down vehicles at the intersection of Kelli Clark Court in Acworth.

The deputy noted in his report the woman was "hysterical" and said Scoggins had been hit by a car. He was bleeding from head and had no pulse at the scene.

Wright said before the fatal crash, a 17-year-old Euharlee girl driving a 2001 Volvo approached an upright pedestrian—apparently the woman—in the right travel lane. The driver reportedly was blocked by another vehicle to her left. 

"The driver took evasive action to avoid the [standing] pedestrian, left the roadway onto the grassy shoulder and hit the pedestrian [who] was lying on the shoulder," Wright said.

No other injuries resulted from the incident and no criminal charges are expected.
